Account Terms

This page contains the most current version of the Terms of Service.

• Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  
• You are responsible for all activity that occurs from your account.
  
• You agree that Learn Drive Survive Safer Drivers Course can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  
• You must not post or submit false information to the Service.
  
• You are responsible for maintaining the security of your account and password. Learn Drive Survive Safer Drivers Course cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  
• Learn Drive Survive Safer Drivers Course has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Learn Drive Survive Safer Drivers Course service, for any reason.
  
• Violation of any of the terms or general conditions may result in the termination of your Account.
  
• In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Learn Drive Survive Safer Drivers Course has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Learn Drive Survive Safer Drivers Course service. Such termination of the Service will result in the deactivation of your Account.
  

Cancellation Rates

Cancellation, non-attendance or the rescheduling of a booking will incur the following charges:

• Less than 48 hours notice before the booking will forfeit the full booking fee.
• Greater than 48 hours or more before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Learn Drive Survive Safer Drivers Course.

 

Refund Policy

CANCELLATIONS / LATE AND/OR NO-SHOW / CHANGE OF BOOKING

We understand that from time to time students may need to reschedule or cancel their booking.  When you book the Safer Drivers Course with Learn Drive Survive SDC, you are securing a spot for a specific time and date as well as the facilitators and/or coaches time. Where a participant needs to re-schedule or cancel, no less than 7 days notice is required. We will make every effort to re-book you for any future session at any available location. If the participant is unable to re-book any other available course dates, a full refund when 7 days or more notice is provided.

Module One - Group Discussion

1. If a participant cancels their Module One session and provides more than 48 hours notice before the commencement of the session, no refund will be offered however, you will be able to re-book another course date.
2. If a participant cancels with less than 48 hours notice before the commencement of the Module One session time, the requirements of the SDC will not be met and the course fee will not be refunded.
3. If a participant simply fails to attend a scheduled Module One session, no refund will be provided.

Module Two - In-Car Coaching

The Module Two component of the course requires two (2) participants at any given time. Where a participant needs to re-schedule this session and provides more than 48 hours notice, every effort will be made to re-book a future session.

1. If a scheduled Module Two Coaching session is cancelled with less than 48 hours notice before the commencement of the session time, the requirements of the SDC will not be met and the full course fee will not be refunded.
2. If one participant is unable to continue with Module Two, all attempts will be made to fulfill the session for the second participant.
3. If a participant simply fails to attend a scheduled Module Two session, no refund will be provided.

If you decide or need to cancel for whatever reason, you must contact Learn Drive Survive on 1800 868 969 within 48 hours of the session commencing or email us at bookings@learndrivesurvivesdc.com.au.

Cancellations can also be made via text message or through Facebook messenger.

PLEASE NOTE: Learners must meet all eligibility criteria for the course. Therefore, all log books must be presented to the LDS facilitator/coach upon arrival for verification. If a student fails to have their current drivers licence on them, they will not be able to drive. Any participants failing to meet the eligibility criteria, will forfeit the entire course fee.

Modifications to Services and Prices

• Learn Drive Survive Safer Drivers Course reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  
• Prices of all Services are subject to change with or without notice.
  
• Learn Drive Survive Safer Drivers Course shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
  

Course Vouchers

• Course Vouchers are non-refundable and cannot be redeemed for cash.
• Unused course vouchers can be transferred between clients.
• Purchases containing multiple course vouchers can be gifted to any number of people at the time of purchase.
• Course Vouchers are valid for 36 months from the date of purchase.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Learn Drive Survive Safer Drivers Course for payment processing.
  
• All fees and transactions are in Australian Dollars.
  

General Conditions

• Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Learn Drive Survive Safer Drivers Course.
  
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Learn Drive Survive Safer Drivers Course customer, employee, member, coach, officer or external contractor will result in immediate account termination.
  
• You must not transmit any worms or viruses or any code of a destructive nature.
  
• You understand that Learn Drive Survive Safer Drivers Course uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  
• Learn Drive Survive Safer Drivers Course does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  
• You expressly understand and agree that Learn Drive Survive Safer Drivers Course shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Learn Drive Survive Safer Drivers Course has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  
• The failure of Learn Drive Survive Safer Drivers Course to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  
• You expressly understand and agree that Learn Drive Survive Safer Drivers Course shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
